These Terms and Conditions ("Terms") govern your access to and use of Book Writer AI (the "App"), the website located at buconeroapps.com (the "Website"), and any related artificial intelligence text generation services, features, or software provided by us (collectively, the "Services").
The Services are owned and operated by Individual entrepreneur MATTEO GIANNESSI, a sole proprietorship registered in Georgia under Identification Number 305858248, with its legal address at Georgia, Tbilisi, Saburtalo district, Bakhtrioni st., №22, apt. №75 (hereinafter referred to as "we", "us", or "our").
Please read these Terms carefully. By downloading, installing, registering an account, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not accept these Terms, you may not access or use the Services.
1. Description of Services
Book Writer AI provides users with mobile tools fueled by artificial intelligence large language models (LLMs) to assist in creative writing, book generation, plotting, editing, and text composition.
We reserve the right to change, suspend, update, or discontinue any feature, AI engine, system limit, or content in the Services at any time, without prior notice or liability to you.
2. Eligibility and User Accounts
Age Requirements: You must be at least 16 years old to use the Services. If you are under 18, you represent that you have received parental or legal guardian consent to use the App.
Account Registration: You must register an account to access and save your creative writing projects. You must provide accurate, current, and complete information and update it immediately if changes occur.
Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all writing activities that occur under your account.
3. Subscriptions and Billing
Paid Subscriptions: Access to premium AI generation capabilities, advanced tools, or specific output thresholds is provided via auto-renewable subscription plans (e.g., monthly or annual).
No Unlimited Plans: The App does not offer an "unlimited" text generation plan. All plans are bound by specific operational thresholds, volume limits, or token balances to ensure stable server functionality.
Billing Processing: All billing transactions are processed securely through third-party app stores (Apple App Store or Google Play Store). Payments are subject to those platforms' terms and refund policies. To the maximum extent permitted by law, payments made to us are non-refundable.
4. Ownership of Generated Content (Intellectual Property)
Your Rights: We do not claim any ownership rights over the text, plots, characters, stories, or books that you generate using Book Writer AI. As between you and us, you own 100% of the output generated by you through the App.
Commercial Use: You retain full commercial rights to publish, distribute, monetize, and sell the generated text (e.g., via digital platforms, self-publishing services like Amazon KDP, or physical print) without any royalty obligations or compensation due to us.
5. User Responsibility & Mandatory Anti-Plagiarism Clause
Critical notice: Artificial Intelligence models process information based on vast training datasets and can occasionally generate phrasing, concepts, or names that resemble existing copyrighted works, trademarks, or public figures.
User Liability: You are solely and fully responsible for the text generated, edited, or published through your account.
Mandatory Verification: You agree and warrant that you will conduct independent checks, reviews, and professional anti-plagiarism screenings before publishing, selling, or commercially distributing any content generated by Book Writer AI.
Hold Harmless: We do not guarantee that the AI-generated outputs will be entirely original or free from accidental similarities to existing literature. You agree to hold us harmless from any third-party claims, lawsuits, or demands regarding copyright infringement, plagiarism, trademark violations, or defamation related to your generated content.
6. Server Storage and Data Retention
Cloud Storage: To allow you to access your stories, books, and writing projects seamlessly across multiple devices, your generated texts and inputs are saved and stored securely on our cloud servers.
Data Security: We employ standard industry practices to keep your data secure. However, no digital storage system is 100% secure. We strongly advise you to maintain external personal backups of your creative work.
Account Deletion: If you choose to permanently delete your account through the App settings, your stored writing projects will be removed from our active production databases within thirty (30) days, subject to standard system logs and backup recovery rotation schedules as outlined in our Privacy Policy.
7. Prohibited Uses
You agree not to use Book Writer AI to generate or distribute text that:
- Promotes violence, extreme hate speech, explicit illegal acts, or severe harassment;
- Is used to automatically spam web services or manipulate online platforms;
- Attempts to reverse engineer, scrape, or extract the underlying API structures, source code, or prompt frameworks of the App.
8. Disclaimer of Warranties
"As Is" Basis: The Services are provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the accuracy, creative quality, grammatical perfection, or market success of the text produced.
AI Anomalies: You acknowledge that AI models can experience "hallucinations," generate factual inaccuracies, or produce unpredictable stylistic results. Use of the App is entirely at your own creative risk.
9. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Individual entrepreneur MATTEO GIANNESSI, his agents, or contractors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of publishing revenue, profits, or book sales;
- Rejection of your manuscript by third-party publishers or online stores (e.g., Amazon KDP) due to AI policies;
- Loss or corruption of text data stored on our servers.
Our total aggregate liability for any claims arising out of or relating to these Terms or the use of the App shall not exceed one hundred Euros (€100.00) or its equivalent in Georgian Lari (GEL).
10. Governing Law and Exclusive Jurisdiction
These Terms, your relationship with us, and any dispute or claim arising out of or in connection with the Services shall be governed by, and construed in accordance with, the laws of Georgia, without regard to its conflict of law principles.
Any legal suit, action, or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the competent courts of Tbilisi, Georgia. You hereby irrevocably consent to the personal and exclusive jurisdiction of such courts.
11. Complete Agreement
If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that specific provision shall be severed, and its invalidity shall not affect the validity and enforceability of the remaining provisions.
