Terms and Conditions for Card Grading AI

These Terms and Conditions ("Terms") govern your access to and use of Card Grading AI (the "App"), the website located at buconeroapps.com (the "Website"), and any related services, features, technologies, or software provided by us (collectively, the "Services").

The Services are owned and operated by Individual entrepreneur MATTEO GIANNESSI, a sole proprietorship registered in Georgia under Identification Number 305858248, with its legal address at Georgia, Tbilisi, Saburtalo district, Bakhtrioni st., №22, apt. №75 (hereinafter referred to as "we", "us", or "our").

Please read these Terms carefully. By downloading, installing, registering an account, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not accept these Terms, you may not access or use the Services.

1. Description of Services

Card Grading AI provides users with mobile tools for trading card collection tracking, market price evaluation, and artificial intelligence-assisted analysis related to card conditioning and grading.

We reserve the right to change, suspend, update, or discontinue any feature, database, algorithm, or content in the Services at any time, without prior notice or liability to you.

2. Eligibility and User Accounts

Age Requirements: You must be at least 16 years old to use the Services. If you are under 18, you represent that you have received parental or legal guardian consent to use the App.

Account Registration: You may be required to register an account to access certain features. You must provide accurate, current, and complete information and update it immediately if changes occur.

Security: You are solely responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account.

Account Deletion: You can delete your account at any time through the App settings. We reserve the right to terminate or suspend your account immediately, without notice, if we suspect a violation of these Terms.

3. Monetization, Subscriptions, and In-App Purchases

Advertisements: The Services are supported by advertising revenue. By using the App, you agree that we may display targeted advertisements and promotions (e.g., via Google AdMob or other mediation networks) within the Services.

In-App Purchases and Subscriptions: Certain premium features may require a paid subscription or one-time payment. All billing transactions are processed through third-party app stores (Apple App Store or Google Play Store). Payments are subject to those platforms' terms and refund policies. To the maximum extent permitted by law, payments made to us are non-refundable.

4. Camera Scanning Feature and Image Data

Camera Permission: The App utilizes a visual recognition feature ("Scanning Feature") that requires access to your device's camera. This feature captures images of physical trading cards solely to identify them, evaluate their condition, or add them to your digital portfolio.

Image Quality & Use: You are responsible for providing images of sufficient quality. You agree not to use the Scanning Feature to capture copyrighted material other than original physical trading cards you legally own or possess.

Data Handling: Scanned images may be processed temporarily on our secure servers or via integrated AI endpoints. We handle this diagnostic data according to our Privacy Policy and do not sell or share your processed images with unauthorized third parties.

5. Third-Party Intellectual Property Disclaimer (Independent Platform)

Critical notice: Card Grading AI is a completely independent utility platform. It is not affiliated with, endorsed by, authorized by, or sponsored by any trading card game publishers, manufacturers, or trademark holders, including but not limited to: The Pokémon Company, Nintendo, GAME FREAK, Creatures Inc., Wizards of the Coast, Konami, Bandai, Disney, or any of their subsidiaries or affiliates.

All product names, card designs, images, and trademarks displayed within the App or utilized for visual recognition are the sole property of their respective rights holders. Their use within this App is strictly for identification, educational, and general market tracking purposes under nominal fair use principles.

6. User Content and Standards

If the App allows you to upload, submit, post, or share lists, text, or photos ("User Content"), you grant us a worldwide, royalty-free, perpetual, and non-exclusive license to use, host, reproduce, and process such material to deliver the Services.

You warrant that you own or have the rights to your User Content and that it does not infringe on any third-party intellectual property or violate any laws. Scraping, crawling, or automated data extraction of card lists or market prices from the App is strictly prohibited.

7. Absolute Disclaimer of Warranties and Accuracy

"As Is" Basis: The Services and all AI-generated analyses, grading simulations, valuations, and market data are provided to you on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind.

No Professional Advice: The valuations, pricing charts, and automated condition analyses provided by the App are generated via automated algorithms and AI models. They are for general information purposes only and do not constitute financial advice, official professional grading certifications (such as PSA, BGS, or CGC), or guaranteed market values. AI models can experience "hallucinations" or errors; you must not rely on the App's outputs to make high-value financial choices, purchases, or sales.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Individual entrepreneur MATTEO GIANNESSI, his agents, or contractors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or data;
• Financial losses resulting from transactions or sales based on the App's price estimations;
• Inaccuracies, errors, or hallucinations in the AI card analysis;
• Hardware damage or battery drain related to the camera scanning features.

Our total aggregate liability for any claims arising out of or relating to these Terms or the use of the Services shall not exceed one hundred Euros (€100.00) or its equivalent in Georgian Lari (GEL).

9. Indemnification

You agree to defend, indemnify, and hold harmless Individual entrepreneur MATTEO GIANNESSI from and against any claims, liabilities, damages, judgments, losses, costs, expenses, or legal fees arising out of your violation of these Terms, your misuse of the App, or your infringement of any third-party intellectual property rights.

10. Governing Law and Exclusive Jurisdiction

These Terms, your relationship with us, and any dispute or claim arising out of or in connection with the Services shall be governed by, and construed in accordance with, the laws of Georgia, without regard to its conflict of law principles.

Any legal suit, action, or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the competent courts of Tbilisi, Georgia. You hereby irrevocably consent to the personal and exclusive jurisdiction of such courts.

11. Severability and Complete Agreement

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that specific provision shall be severed, and its invalidity shall not affect the validity and enforceability of the remaining provisions. These Terms and our Privacy Policy constitute the entire legal agreement between you and us regarding Card Grading AI.

This privacy policy applies to the Card Grading AI app (hereby referred to as "Application") for mobile devices that was created by Lolpo91 (hereby referred to as "Service Provider") as a Free service. This service is intended for use "AS IS".

Information Collection and Use

The Application collects information when you download and use it. This information may include information such as:

• Your device's Internet Protocol address (e.g. IP address)
• The pages of the Application that you visit, the time and date of your visit, the time spent on those pages
• The time spent on the Application
• The operating system you use on your mobile device

The Application does not gather precise information about the location of your mobile device.

The Service Provider may use the information you provided to contact you from time to time to provide you with important information, required notices and marketing promotions.

For a better experience, while using the Application, the Service Provider may require you to provide us with certain personally identifiable information, including but not limited to email, user id. The information that the Service Provider request will be retained by them and used as described in this privacy policy.

Third Party Access

Only aggregated, anonymized data is periodically transmitted to external services to aid the Service Provider in improving the Application and their service. The Service Provider may share your information with third parties in the ways that are described in this privacy statement.

Please note that the Application utilizes third-party services that have their own Privacy Policy about handling data. Below are the links to the Privacy Policy of the third-party service providers used by the Application:

• AdMob
• Google Analytics for Firebase
• Firebase Crashlytics

The Service Provider may disclose User Provided and Automatically Collected Information:

• as required by law, such as to comply with a subpoena, or similar legal process;
• when they believe in good faith that disclosure is necessary to protect their rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
• with their trusted services providers who work on their behalf, do not have an independent use of the information we disclose to them, and have agreed to adhere to the rules set forth in this privacy statement.

Opt-Out Rights

You can stop all collection of information by the Application easily by uninstalling it. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

Data Retention Policy

The Service Provider will retain User Provided data for as long as you use the Application and for a reasonable time thereafter. If you'd like them to delete User Provided Data that you have provided via the Application, please contact them at cgacardgradingai@gmail.com and they will respond in a reasonable time.

Children

The Service Provider does not use the Application to knowingly solicit data from or market to children under the age of 13.

The Application does not address anyone under the age of 13. The Service Provider does not knowingly collect personally identifiable information from children under 13 years of age. In the case the Service Provider discover that a child under 13 has provided personal information, the Service Provider will immediately delete this from their servers. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact the Service Provider (cgacardgradingai@gmail.com) so that they will be able to take the necessary actions.

Security

The Service Provider is concerned about safeguarding the confidentiality of your information. The Service Provider provides physical, electronic, and procedural safeguards to protect information the Service Provider processes and maintains.

Changes

This Privacy Policy may be updated from time to time for any reason. The Service Provider will notify you of any changes to the Privacy Policy by updating this page with the new Privacy Policy. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.

This privacy policy is effective as of 2025-10-05.

By using the Application, you are consenting to the processing of your information as set forth in this Privacy Policy now and as amended by us.
